That information can be found on the oandpsolutions.org website under
documents and then lawsuits. A lawsuit was filed on November 1st, before
the election, by the AMA and four other hospitals against Secretary of
Health and Human Services, Kathleen Sebelius, in her capacity as
Secretary. As I recall, part of that suit includes damages caused by
careless CMS auditors. Unfortunately, O&P is not involved in this lawsuit.
Also, from what we have read, HR 6575 does not include part B Medicare.
I may be wrong about this, but until I am shown otherwise, I believe I'm
correct. It would be wonderful if we could be included in this
legislation, but I doubt that is possible. Hopefully, we'll hear more
about this soon from some of our legal experts. This could be a big deal
for us if we were included.

Can anyone forward me the email? It was specific only to the RACs and the proposed legislation (not the physician letter and other stuff) and mentioned how they could be held financially accountable for errant audits and specific points like that.
