Greetings to all,
 
My company is going through a Sales Tax Audit. The State auditor holds fast
to his stance that on diabetic shoes, sold to a IDD Medicare patient with a
script and medical necessity from the patients doctor that is treating his
diabetes, must pay sales tax on the remaining 20%.
 
We bill medicare for the medicare allowable, 80% of the claim is paid by
Medicare and then the claim is forwarded to the secondary that pays the 20%. We
are not able to add sales tax to Medicare and do not have a chance to amend
the claim to the secondary. Am I missing something? If you are doing business
in Missouri, are you collecting sales tax on the 20%.
 
More importantly, if you have recently gone through a Sales Tax Audit in any
state, (and lived to tell about it)did they require this from you?
