There was a long time ago, a raido news reporter who always signed on with:
Ah, there's good news tonight!

There is a priceless little tidbit to be found in the case of Maximim
Comfort, Inc v. Tommy S. Thompson, Secretary of Health and Human Services of
the United States. I believe the following is the case number; NO. CIV.
S-03-1584 LKK/PAN.

For anyone who currently has claims tied up or who has been denied payments
because of the Audits, this should get your claims paid. It is a
permanent injunction that says Defendant, and his agents, officers,
employees, representatives and all persons acting in concert or
participating with him, are ENJOINED (sic) from recouping, offsetting or
otherwise collecting from plaintiff any alleged overpayments for any of the
beneficiaries which are the subject of this action..................

Maximum Comfort, Inc. had provided electric wheelchairs, and had the
necessary CMNs and Medicare, through its 'Audit methods, came after them
because the additional medical information they requested did not support
the need. The U.S. District Court Judge agreed with Maximum, that CMS does
not have the authority to do that and therfore isssued the injunction.
