Regarding some of the mentions on the List about Orthotic devices delivered
during a Part A stay in either hospitals or SNFs; (or prostheses in a
Hospital stay)
The 2 day (48 hour) rule allows for fitting/TRAINING for the use & care
only by appropriate staff and then bagged for patient use @ HOME on
discharge which is the DOS. If during that time, the device is used for
TREATMENT by PT or OT and is charted, the exemption for early delivery
would be considered void in a review/audit. I have had to explain this
rule and provide the specific documentation to SNF/Hospital stakeholders
many, many times since the rule came into effect. The consequences of not
following the rule or trying to skirt around it can be harsh for both
provider and facility.
I must mention that I relied on AOPA for clarification many times,
particularly Devon Bernard who was on my speed dial list. He is a fountain
of information and explained how this rule originally came about and was
geared towards patients on oxygen pending discharge.
