Greetings list,
Question regarding a patient requesting their records from another provider.

Scenario,
A patient of mine has filled out the necessary legal documents to request her records be sent to my office from another provider. She has requested this information verbally and filled out the previous provider’s own paperwork required to release her chart. When my office staff calls the company to ask the status of the records, they now state that even though the patient has filled out the paperwork to release her records, they have the right to refuse this request and they will not be sending the records.

Beyond the obvious lack of professionalism, can this company refuse to release a patient’s records to the patient?

Short of calling lawyers, what recourse does this patient have?
