In some cases I will make an AFO or other item for a patient in a rehab
facility. I do this so the patient can use the item while they are receiving
therapy. I know the Medicare rule states we can bill for the item 3 days
before the patient leaves the facility. But, Is there anything that keeps me
from giving the patient an AFO or prosthesis and then billing for it when
the patient leaves the facility? My paperwork shows I picked up the trial or
evaluation AFO or prosthesis and then delivered the definitive item when
they leave. So for those of you more involved with the ethical and Medicare
aspect of this business...am I doing anything wrong in this case? It seems
this is beneficial to the patient because they get more training with the
device they are going home with..instead of some off the shelf AFO that
doesn't fit. The patients overall outcome is better because they get more
training and they are more likely to except the device and use the device. I
was curious if anyone else was doing this..and if there is anything legally
or ethical I should be concerned about.
