I would like to thank all those who were kind enough to respond to my
question. Below I have provided a copy of the responses I received. Also,
we did send in our request to the ALJ after C2C's final denial of our
appeals. I state this, because that was a question many had for me.
My original question is provided below.
Again, thanks to all for their responses!
Sincerely,

I have a couple of large claims that I have been waiting to hear from the
ALJ to get a hearing scheduled. I believe both of these claims have been
sent to the ALJ from C2C in Feb. 2013. We have yet to hear from the ALJ.
Is there a protocol or deadline that the ALJ has to respond or acknowledge
that they have received the ALJ request?
Thanks in Advance!

Just keep waiting. We have been in the same situation with claims from last
March.
Just recently received a letter from the ALJ stating that all claims are
taking about 230 days from request for hearing.
Good luck and keep fighting.
We have a letter stating that our case went to the ALJ Nov 8th, 2012 & that
the ALJ office will be contacting us shortly. A disclaimer at the bottom
of the letter regretfully informs us that there is an enormous backlog &
they cannot say when our case will be heard. Meanwhile they have our
money!
YOU need to file the appeal to the ALJ after a unfavorable C2C decision.
and you need to do it within 60 days of the C2C decision.
Your email seems to indicate that you are under the impression that C2C
sends your case to the ALJ. It does not.
You need to file that appeal.and again, within 60 days of their decision.
Did you send the request yourself or did you think C2C sent it for you?
C2C does not send the request to the ALJ. The supplier completes the ALJ
Hearing Request form (see attached) and sends it to the ALJ at this address:
HHS OMHA Centralized Docketing
200 Public Square, Suite 1260
Cleveland, OH 44114-2316
You can write to the above address with a list of your hearing requests to
ask for confirmation on the receipt of the requests. In the past, before
the huge back log in cases to be heard, providers would receive a
confirmation via mail of the receipt of the hearing request. I have only
received these now after inquiring on them. It is strongly suggested that
the requests and inquiries are sent in such a manner that you will receive
delivery confirmation, for example Express Mail or Certified Mail with
Return Receipt Requested via the United States Postal Service.
You can also contact the Centralized Docketing office at 1-216-615-4011.
Leave a message and someone will return your call.
First did you send in the ALJ request? C2C does not forward the request to
the ALJ. You have to do that. Read your C2C denial and it has those
instructions. Be aware of your cut off dates.
I have two claims sent in about February 2013. They're large claims with
delivery dates in August 2012. I just received my ALJ hearing. FEBRUARY
2014. Unbelievable. Both new AK amputees at K3 level. Mauch knee and
variflex foot.
You need to contact them again they are supposed to schedule the i ALJ
hearing within 90 days but they are way behind. They do res.pond
None at all. It all depends on the load. We had 2 hearings in May of 2012
and received favorable notice just yesterday (Monday).
we are in the same boat...several claims submitted for an ALJ hearing in
12/2012. No scheduled dates, yet. Our audit consultant states they aren't
required to respond that they have received the requests. Because of the
backlog they are seeing in ALJ offices he doesn't expect our claims to be
heard until 1st or 2nd quarter of 2014.
I just received notification on one that was filed in October of 2012 that
said that it had just been forwarded to the assigned judge and it would be
another 152+ days before a hearing. You can call the ALJ to confirm
receipt. I have several in the ALJ and I am always able to obtain updates
quicker by calling than awaiting the letters.
Good luck!
