I have a case going to the ALJ level. I feel confident of the medical necessity however if I loose, I know I can't bill the patient but can I get the prosthesis back. The way I see it if Medicare denies the patients prosthesis I should be able to get the leg back? The kicker in the situation is the patient will go irate and this is what will impact change. The patient in question uses their prosthesis from the time they wake up until they go to bed. They're one of my most active patients. The denial is based on the patient receiving a power wheel chair prior to myself being in the picture. I never new about the power wheel chair and the patient came in on crutches for all appointments. The patient wrote a letter stating they never wanted the wheelchair and was talked into it and would gladly give it back.

Thanks for any advice on retrieving a delivered prosthesis after a final denial,
