The case presented is absolutely remarkable and representative of all that is
wrong with the audit process. What Brett describes as the documentation he had
on hand from the beginning, not to mention what was sent in the first two levels
of appeal, would probably been approved by the most paranoid of office staff and
given the OK to bill with the KX modifier. I have often heard speculation that
one of the goals of the toughening up of the diabetic documentation requirements
is simply to reduce the number of providers, thereby perhaps reducing the number
of claims. If so, then perhaps that is just what should happen. Although it has
long been a challenge for the o and p community to speak with one voice, I think
we would be best served on this particular issue to just say no mas. It could
be that the best thing would be for all Certified and Licensed Practitioners as
well as ABC accredited facilities to place a moratorium in providing any
diabetic shoes and inserts. Leave it to the other qualified providers.
