Hello Colleagues and Guests again,

One of the reasons why CMS is sending out these new regulations and
policy changes is because some of us continue to bill using L5999 and
other L*999 codes after CMS has told us not to use them. Medicare has
been telling us not to use the L5999 codes for microprocessor knees now
for about a year. But some of our manufacturers continue to suggest
L-Codes that are incorrect in one breath and then go on to tell us in
the next breath that it is our responsibility to accurately code their
products when used with our Medicare services. Why is it that companies
can advertise their products falsely regarding Medicare L-Codes and not
be held liable for their actions? This stuff has been going on for years
and we only turn our heads as though it doesn't matter. Do you still
believe that?

As I have said many times before, at the end of the day, the
you-know-what is going to hit the fan and it appears that it already
has. So remember, without guns and ammo, it is senseless to try digging
out of a foxhole, lest you be shot in the rear. That is one more reason
why we should participate in the speak4OandP.now video project. The more
we can expose the issues and the problems and get them in front of
someone who can help us, the better and quicker our chances will be for
corrective actions.

If anyone can forward release forms that have been approved by your
legal teams and want to make them available for publication, I would be
happy to post them on the OP-Repository.org website. I do understand
though, that some forms may be good in one state and not in another, so
these things would have to be kept in mind. I'm not sure we need forms
for the practitioners who are making their cases without patients
involved, but we need to check this out as well. If anyone has knowledge
about this, please speak up.

A blind man once stood at the traffic light corner waiting for the
go-ahead to cross when his companion dog raised its leg and whizzed all
over the man's leg. Without hesitation he reached into coat pocket and
pulled out a cookie. A lady standing beside him interrupted and said,
Sir I don't believe what I am seeing. You are so kind and
compassionate. That dog just whizzed all over your leg and you are going
to reward him with a cookie. How wonderful and nice. The blind man
replied, Madam you don't quite understand. I am giving him the cookie
so I know which end to kick. So things are not always as they seem.
Just because you get a cookie, it doesn't mean you're not going to get
your butt kicked.
