Hello Colleagues and Guests,

I submitted an SBA (Small Business Administration) Ombudsman Complaint
(Comment) form on August 18, 2012 and received a reply yesterday
8/21/12. The complaint was forwarded to CMS for a high level review and
response. I won't publish information at this time, but I wanted folks
to see that the SBA appears to be taking this matter seriously, as I
thought they would. If others from around the country who have
legitimate complaints with the prepayment auditing process, I would
suggest that you file a similar complaint with the SBA. In particular,
the Regulatory Flexibility Act, which is posted on the
oandpsolutions.org website, appears to be something that may prove to be
beneficial for us as we work through this issue. You may want to read
that article or the condensed version which is also published on the
website. I believe you will find it interesting.

We are anxious to hear the CMS reply and hope that it too comes in a
timely manner. We don't have any guarantee that their reply will solve
our problems, but it demonstrates that folks in the SBA are willing to
look at fairness matters with us and they are doing it in a very
expeditious manner. If enough of us get involved, I believe we will make
significant improvements with the O&P reporting and billing issues
currently required by Medicare. When the reply from CMS comes, we'll let
you know the outcome.

I hope some of you will also forward a complaint form to the SBA. Thanks
