Hi everyone,
I am a physician attempting to start an O&P company with a local prosthetist who is BOCO certified. Currently my partner is working for a competitor who has an iron clad non compete. We cannot do anything for one year within 12 miles. I am looking to start the company in March of 2013 and have her join us in one year when her non compete is over. It will take us approx 1 year to apply for all the different insurance companies and get set up.
I do however need to apply for a medicare ID with her name, but I am not sure if that is violating her non compete. I have asked two contract lawyers who have the same answer 'it is difficult to say'
Does anyone know if the medicare ID number is publicly disclosed? if so that may violate her non compete for 'intent to form a business'
Also when we are visited by JCAHO and ABC does she need to be present?
My other thought was to find a prosthetist who's name I can use on my Medicare ID until my partner's non compete is over and then switch it back to her. For which I would give a stipend to use. Does that sound like a reasonable idea?
