I am reaching out to a few folks to pose a question and find some resources for information, as I am butting heads with our legal department regarding our common practice as prosthetists. It is my understanding that if a patient purchases a T-shirt or other material regardless of what is printed on that item, they are the legal owner and can display that item any way they choose so long as it is not being reproduced. Do you know of any controversy or question to the contrary? For example, a child brings to me a Superman shirt to be laminated into his or her prosthetic socket. I did not purchase the item for resale nor am I reproducing the image. I do not believe we have violated any law but our attorney here seems to think we have. What are your thoughts or do you have any resource recommendations?
