To those of you who responded, thank you. I have been asked to post responses but unfortunately, I am not technically able to figure that out. The results were as I thought. No , Medicare is not responsible for this failure, thus not to be billed for the new orthosis, (which is under warrantee) My concern is with my time addressing the failure and cost to return the defective part , and for that most, but not all, suggested a repair charge to Medicare, well documented with time spent on task as evidence in the event of need for appeal, with patient signing off on the time spent. Also, pictures of the failed device would be nice. Again, thanks for your advice. Makes sense.
