Recently, I was asked to help support pending New York legislation that
would force insurance companies to include prosthetic services in their
health care policies.

The pending New York Bill # A450 i.e.. Gunther Insurance Law, Amendment
SS3216,3221 & 4303 ,Ins L relates to:

All health care insurance providers in the state are to provide mandatory
health insurance coverage for providing prosthetic devices equal to or above
Medicare's standard of coverage; includes the repair of replacement of a
prosthetic device required to be worn or used by a policy holder; coverage
includes expenses for assessment.evaluation,treatment,management,and follow
up care.

I'm sorry, but I could not, in full and good conscious, support this bill
being introduced in New York and other states where the providers , of
these specialized health care services; evaluating , diagnosing,
fabrication and fitting of comprehensive prosthetic devices , are not
licensed under the state ( unregulated ) nor are minimum educational
standards for providers are not established nor required.

The Summary of Specific Provision reads :

Amends several sections of the insurance Law to mandate coverage by health
insurance providers fro prosthetic devices.

In my opinion, enacting such legislation,without regard to provider
accountability under state regulation, nor mandatory qualifications of the
provider, would be detrimental to the credability of the profession and
health and mental safety of the patient it is supposed to serve.

It may create a wave of additional unqualified and untrained providers,
knowing mandatory insurance coverage is available for state resident
beneficiaries.

Fiscal Implications:

None to the state

Quite the contrary, if a patient requiring these highly skilled
comprehensive health care services, is subject to unqualified and untrained
health care services by a provider, the patient could easily be subject to
further harm and may deter ate the patient's initial health condition ,
resulting in becoming a financial burden to the state and welfare programs..


On the other hand, I could provide justification of supporting this bill if
it was aligned to a regulation act of O&P that mandating that all providers
be meaningfully licensed under the supervision of a New York State Board of
Orthotists and Prosthetists, under the jurisdiction of a the New York
Department of Health as is required in 10 other states in the USA.

This is an excellant opportunity for O&P providers to become motivated and
rally support for regulating their profession.
