I was reviewing some Ossur documents when I found a 'Confidentiality
Agreement' signed by Mark Emery, CFO of Ossur and dated March 18, 2003.
This agreement, which is a very brief 1 1/2 pages in length has an
interesting section on Use and Disclosure of Health Information.
The section in it's entirety reads....
2. Permitted Uses and Disclosures by Ossur.
a. Ossur may use and disclose Health Information for the purposes of (i)
providing prosthetic or orthotic devices to Patients; (ii) meeting Ossur's
legal and professional obligations with respect to such prosthetic or
orthotic devices, including maintaining list of Patients in the event of a
recall of the relevant prosthetic or orthotic device; and (iii) the proper
management and administration of Ossur. Ossur agrees not to use or disclose
Health Information other than as permitted by this Agreement or as required
by law.
There is no (b)..this is the complete text of that section.
Now...after reading that, does it sound like Ossur is saying they are going
to mass mail patients? or just maintain a list in the event a recall makes
the contact necessary?
