You should know that a recent regulation will allow the adjustment of
Medicare Part B reimbursement rates, including O&P payments, that are
determined to be grossly excessive or deficient. This regulation,
called inherent reasonableness (IR) authority and issued by the Centers
for Medicare and Medicaid Services (CMS), will allow the agency to
unilaterally adjust Medicare reimbursement rates on a code by code
basis.
IR authority grants Medicare the ability to reduce or increase payments
by up to 15 percent per year until the payment is considered to be in
line with what Medicare deems to be reasonable.
Among other issues, AOPA is concerned that the IR process currently
lacks an appeals mechanism, which means that practitioners and
manufacturers do not have the opportunity to appeal payment rate
adjustments.
AOPA shared these and other concerns in a hand-delivered letter to the
Centers for Medicare and Medicaid Services (CMS) on the Interim Final
Rule for Inherent Reasonableness (IR).
