Competitive Bidding on Hold Through the November Elections

The Senate failed yesterday in its third attempt in a month to allow a
floor vote on the Medicare provider give-back package, which includes
competitive bidding for a wide range of orthotic services. The Senate's
failure to act virtually assures that no Medicare-related legislation
will be enacted prior to the election on November 5. Action on the
Senate Medicare package, in part, was stalled because of the strong
opposition raised to competitive bidding by AOPA and its members.

Despite the failure of the Senate to pass this Medicare package, the
threat of future action on competitive bidding remains extremely high.
Such action could occur during a lame duck session following the
election, at which time lawmakers could address Medicare issues and pass
legislation that includes competitive bidding.

AOPA thanks all those in the O&P community who have taken time to write
or call their lawmakers expressing strong opposition to this proposal.
These grassroots efforts make a significant difference and amplify the
message delivered by AOPA's legislative team. We ask, however, that you
continue to keep up the pressure through phone calls and letters. We
also strongly encourage you to invite your House and Senate lawmakers to
tour your facility before January 20. It is important for these
decision makers to see first hand the complexity of fitting orthotic
devices to patients and witness how O&P practitioners improve the
quality of life for patients. If you would like assistance in setting
