 `(II) QUALIFIED PRACTITIONER- The term `qualified practitioner' means a physician or health professional who-

`(aa) is specifically trained and educated to provide or manage the provision of custom-designed, fabricated, modified, and fitted orthotics and prosthetics, and is either certified by the American Board for Certification in Orthotics and Prosthetics, Inc., or is credentialed and approved by a program that the Secretary determines, in consultation with appropriate experts in orthotics and prosthetics, has training and education standards that are necessary to provide applicable items;

`(bb) is licensed in orthotics or prosthetics by the State in which the applicable item is supplied; or

`(cc) has completed at least 10 years practice in the provision of applicable items

Earlier this year, AOPA's Government Relations Section met with representatives of the APTA and the AOTA to reconcile PT & OT concerns about the language. The result of this session was an apparent capitulation as to the qualifications requirements. The revised qualification language has been incorporated into H.R. 5612 as introduced by Rep. Charles Rangel on 10-30-2000. Sec.426 reads in part...

`(iii) QUALIFIED PRACTITIONER DEFINED- In this subparagraph, the term `qualified practitioner' means a physician or other individual who-`

(I) is a qualified physical therapist or a qualified occupational therapist;`

(II) in the case of a State that provides for the licensing of orthotics and prosthetics, is licensed in orthotics or prosthetics by the State in which the item is supplied; or`

(III) in the case of a State that does not provide for the licensing of orthotics and prosthetics, is specifically trained and educated to provide or manage the provision of prosthetics and custom-designed or fabricated orthotics, and is certified by the American Board for Certification in Orthotics and Prosthetics, Inc. or by the Board for Orthotist/Prosthetist Certification, or is credentialed and approved by a program that the Secretary determines, in consultation with appropriate experts in orthotics and prosthetics, has training and education standards that are necessary to provide such prosthetics and orthotics.

As of 11-09-2000, H.R.5612 was sent to the House Subcommittee on Health and Environment where it remains today( from searching through the Thomas legislative information website <URL Redacted> ). Let your national office know where you stand on this issue and inform any legislative contacts about your concerns.

 My opinion is that if our national organization had expended as much energy in insisting on baseline educational and training standards for P&O practitioners as they did with cranial helmets' our profession would be better served. AOPA has been charged with representing member firms and their individual practitioners in matters of governmental affairs and should not be in the business of selling farms.
