Yesterday Mr. Hewey posted a link to a new bill that is a modification
of the old Harkin amendment. I was surprised there was not one reply on
the list. I also just skimmed his post, considered it a rehash of old
business, and forgot about it. This morning I got a call from a friend
asking if I had seen how the bill had been changed. I went back and
looked again! I then went and did a search of current pending
legislation and turned up numerous bills that would greatly impact O&P
as we know it.

My search yielded the following bill that would define what a qualified
provider is for Medicare payments:


     1 . William G. Barr Amputee Protection Act of 1999 (Introduced in

2 . To amend title XVIII of the Social Security Act to establish
standards for payment under the Medicare Program for certain orthotic,
prosthetic, and pedorthic devices. (Introduced in the
House)[H.R.5156.IH] A New bill including pedorthics
3 . Medicare Waste Tax Reduction Act of 1999 (Introduced in the
Senate)[S.1451.IS] Old Harkin bill
7 . Fiscal Responsibility Act of 1999 (Introduced in the
Senate)[S.1959.IS] Old Harkin bill
12 . Medicare, Medicaid, and SCHIP Benefits Improvement and Protection
Act of 2000 (Introduced in the House)[H.R.5543.IH] New Bill includes
PT/OT and BOC
13 . Medicare, Medicaid, and SCHIP Benefits Improvement and Protection
Act of 2000 (Introduced in the House)[H.R.5601.IH] New Bill includes
PT/OT and BOC
14 . Medicare, Medicaid, and SCHIP Benefits Improvement and Beneficiary
Protection Act of 2000 (Introduced in the House)[H.R.5612.IH] New
Bill includes PT/OT and BOC
15 . Medicare, Medicaid, and SCHIP Balanced Budget Refinement Act of
2000 (Introduced in the Senate)[S.3077.IS] New bill includes BOC
16 . Medicare, Medicaid, and SCHIP Balanced Budget Refinement Act of
2000 (Introduced in the House)[H.R.5324.IH] New bill includes BOC

The bills that include PT/OT's define them as qualified, without
defining specified education or training requirements.
The bills including BOC practitioners also do not provide requirements
as to education or training, merely the act of being certified is proof
of qualification.

If, as Mr. Hewey asserts, AOPA brokered a deal to include PT/OT's and
BOC in future legislation are they openly demonstrating their lack of
commitment to the ABC credentials?

Does no one have an opinion or is this not one of the approved
clinical topics of discussion?
