HARKIN BILL INTRODUCED
Senator Tom Harkin (D-IA) has introduced his Medicare Waste Tax Reduction
Act of 1999. This proposal contains language to limit access to the
custom L codes to qualified providers. S. 1451 has been cosponsored by
Senators Biden (D-DE), Graham (D-FL) and Hollings (D-SC). The section of
S. 1451 that covers custom orthotics and prosthetics:
Requires that only those individuals who have received specific training in
the provision of custom designed, fabricated, modified and fitted orthotics
and prosthetics may bill Medicare for these services or products.
No payment shall be made for custom orthotics and prosthetics unless a
qualified supplier or provider (as defined by the HHS Secretary) provided
the device.
Qualified supplier is defined as any entity accredited by the American
Board for Certification in Orthotics and Prosthetics, Inc. or accredited
and approved by a program that the Secretary determines has accreditation
and approval standards that are essentially equivalent to those of such
Board.
Qualified practitioners are defined as any health care professional who is
specifically trained and educated to provide or manage provision of
custom-designed, fabricated, modified and fitted orthotics and prosthetics
and is either certified by the American Board for Certification in
Orthotics and Prosthetics, Inc.; credentialed by a program that the
Secretary determines has training and education standards that are
necessary to provide custom-designed, fabricated, modified and fitted
orthotics and prosthetics; is licensed in orthotics or prosthetics by the
State in which the applicable item is supplied; or has completed at least
10 years practice in the provision of applicable O&P devices.
